This website is operated by BLACK LABEL DESIGN SRL under the AÏTHE brand. Throughout the site, the terms “AÏTHE”, “we”, “us” and “our” refer to BLACK LABEL DESIGN SRL.
AÏTHE offers this website, including all information, products, tools and services available through it, to you, the user, subject to your acceptance of the terms, conditions, policies and notices stated herein.
By visiting our website and/or purchasing something from us, you engage in our service and agree to be bound by these Terms and Conditions (“Terms”), together with any additional policies referenced herein or made available on our website, including our Shipping & Delivery Policy, Returns & Exchanges Policy, Privacy Policy and Cookie Policy.
Please read these Terms carefully before accessing or using our website or placing an order.
Nothing contained in these Terms is intended to exclude, restrict or otherwise affect any mandatory rights available to consumers under applicable law.
SECTION 1 - ONLINE STORE TERMS
By using this website, you confirm that you have the legal capacity required to enter into a binding agreement under the laws applicable to you.
You may not use our website or products for any unlawful or unauthorised purpose, nor may you violate any applicable laws in connection with your use of our website.
You must not transmit viruses, malicious code or any other material capable of interfering with or damaging the operation or security of the website.
A breach of these Terms may result in the restriction or termination of your access to our services where appropriate.

Our registered office is not a return address. Customers wishing to make a return must follow the procedure described in our Returns & Exchanges Policy. Return instructions and the appropriate Bucharest return address will be provided following registration of the return request.
Romanian ecommerce law requires identifying and contact information such as the trader’s name, registered office, phone number, email address, trade registration and fiscal identification to be easily and permanently accessible.
SECTION 3 - GENERAL CONDITIONS
We reserve the right to refuse service, restrict access or decline an order where reasonably justified and permitted by applicable law, including in cases involving suspected fraud, misuse of the website, unauthorised payment activity or violations of these Terms.
You agree not to reproduce, duplicate, copy, sell, resell or commercially exploit any portion of the website or its content without our prior written permission, except where permitted by law.
The headings used in these Terms are included for convenience and do not limit or otherwise affect the provisions to which they relate.
SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We make reasonable efforts to ensure that information displayed on our website is accurate and current.
However, occasional typographical errors, omissions or inaccuracies may occur in relation to product descriptions, pricing, availability, shipping information, measurements or other website content.
We reserve the right to correct such information when identified, subject to applicable consumer law.
Information provided on the website may be updated or modified from time to time.
SECTION 5 - PRODUCTS
Certain products may be available exclusively through our online store and may be available in limited quantities.
We make every reasonable effort to display product colours, textures, details and proportions as accurately as possible. However, the appearance of colours may vary depending on your device, display settings, lighting and other technical factors.
Product measurements and fit information are provided as guidance and should be considered together with our Size Guide.
Some AÏTHE pieces are held in stock, while selected pieces may be produced or prepared following the placement of an order.
SECTION 6 - PERSONALISED AND CUSTOMISED PRODUCTS
AÏTHE may offer individual alterations or customisations at the customer’s request.
These may include, without limitation, shortening or lengthening a garment, producing a garment according to individual measurements, custom fit adjustments, non-standard colours or fabrics, or other specifications requested by the customer.
Customers are responsible for ensuring that measurements and specifications supplied to AÏTHE are accurate.
Products manufactured according to the customer’s individual specifications or otherwise clearly personalised may not be eligible for cancellation, return or exchange where applicable law provides such an exception.
Romanian consumer law specifically excludes clearly personalised goods or goods produced according to specifications supplied by the consumer from the statutory withdrawal right.

SECTION 7 - PRICES
Product prices are displayed in the currency applicable to the market or location selected through our website.
Prices may be changed from time to time without prior notice. Any price change will not affect an order for which a binding contract has already been concluded, except where permitted by law.
Shipping charges, where applicable, are displayed before completion of checkout.
For orders delivered outside the European Union, additional import duties, taxes, customs clearance charges or carrier fees may apply as described in our Shipping & Delivery Policy.
SECTION 8 - ORDERS AND CONTRACT FORMATION
By placing an order, you offer to purchase the selected products in accordance with these Terms.
Before submitting your order, you are responsible for reviewing the products, sizes, quantities, delivery information and total amount displayed during checkout.
After your order is submitted, you will receive an electronic order confirmation.
A distance sales contract is concluded when AÏTHE confirms acceptance of the order on a durable medium.
Once an order has been confirmed, it enters processing automatically.
For operational reasons, we cannot guarantee that requests to modify or cancel an order can be accommodated after confirmation. This does not affect any statutory withdrawal rights applicable to eligible products.
SECTION 9 - ORDER ACCEPTANCE AND AVAILABILITY
All orders remain subject to product availability and successful payment authorisation.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
a product is no longer available;
payment has not been authorised;
fraudulent or unauthorised activity is reasonably suspected;
the information supplied by the customer is materially incomplete or incorrect;
an obvious pricing or technical error has occurred;
delivery to the selected destination is not possible; or
the order otherwise cannot lawfully be fulfilled.
Where payment has already been collected for an order that we are unable to fulfil, any amount due will be reimbursed in accordance with applicable law.
SECTION 10 - PAYMENT
Payment must be made using one of the payment methods offered at checkout.
Available payment methods may vary according to destination, currency, device or payment provider.
Payments are processed through authorised third-party payment providers.
Payment transactions may be subject to security, authentication and fraud-prevention checks.
Customers must provide accurate and authorised payment information when placing an order.
SECTION 11 - BILLING AND CUSTOMER INFORMATION
You agree to provide current, complete and accurate information when making a purchase.
This includes your full name, billing information, shipping address, telephone number, email address and any other information reasonably required to process or deliver your order.
You are responsible for ensuring that the delivery information supplied is correct.
Additional charges resulting from incorrect or incomplete delivery information may be borne by the customer where permitted by applicable law and as further described in our Shipping & Delivery Policy.
SECTION 12 - SHIPPING AND DELIVERY
Orders are prepared and shipped in accordance with our Shipping & Delivery Policy.
AÏTHE orders are normally fulfilled within approximately 1-4 business days, Monday through Friday, excluding public holidays.
Estimated courier transit times following dispatch are:
Romania: 1-3 business days
Europe: 1-5 business days
International: 2-7 business days
International orders are generally shipped using DHL Express, while deliveries within Romania are made using FAN Courier or Sameday.
Delivery times are estimates rather than guaranteed delivery dates.

SECTION 13 - INTERNATIONAL ORDERS, CUSTOMS AND DUTIES
Orders shipped outside the European Union may be subject to import duties, import taxes, customs clearance costs, brokerage fees or other charges imposed by the destination country or shipping carrier.
Unless expressly stated otherwise at checkout, these charges are not included in the product price or shipping fee and are the responsibility of the recipient.
AÏTHE does not control the amount imposed by foreign customs authorities.
Customers are responsible for complying with import requirements applicable in their destination country.

SECTION 14 - RETURNS AND EXCHANGES
Eligible products purchased online may be returned in accordance with our Returns & Exchanges Policy.
Where the statutory EU and Romanian withdrawal right applies, consumers generally have 14 calendar days from delivery to communicate their decision to withdraw from the contract.
The customer bears the direct cost of returning eligible change-of-mind purchases where they have been informed of this obligation, subject to applicable law.
Products must be handled only to the extent reasonably necessary to establish their nature, characteristics and fit. Any diminution in value caused by handling beyond what is necessary may be taken into account where permitted by law.
Personalised products and products made according to individual customer specifications may be excluded from the statutory right of withdrawal.
AÏTHE does not offer commercial exchanges on sale items. Where mandatory law provides a statutory withdrawal right for a discounted item, that right remains unaffected.

SECTION 15 - LEGAL GUARANTEE OF CONFORMITY
AÏTHE is responsible for delivering products that conform to the contract.
Mandatory legal rights relating to defective or non-conforming goods remain unaffected by our commercial Returns & Exchanges Policy.
For Romanian consumers, the applicable statutory guarantee of conformity for goods has a minimum duration of two years under the current consumer protection framework.
If you receive a faulty, damaged or incorrect product, please contact hello@maisonaithe.com as soon as reasonably possible.
We may request photographs or other information necessary to assess the issue.
SECTION 16 - SALE ITEMS AND PROMOTIONS
Sale prices, promotional campaigns and discount codes may be subject to specific conditions communicated at the time of the relevant promotion.
Discount codes cannot be exchanged for cash unless expressly stated otherwise.
Unless otherwise specified, only one promotional code may be used per order where the checkout system does not permit combinations.
Commercial exchanges are not offered on sale items.
Nothing in this section restricts mandatory statutory rights available to consumers.
SECTION 17 - INTELLECTUAL PROPERTY
All content made available through the AÏTHE website, including without limitation the AÏTHE name, trademarks, logos, product designs, photographs, videos, graphics, text, website design and other creative material, is owned by or licensed to BLACK LABEL DESIGN SRL unless otherwise stated.
Such content may not be copied, reproduced, distributed, published, modified or commercially exploited without prior written authorisation, except as permitted by applicable law.
SECTION 18 - THIRD-PARTY SERVICES AND LINKS
Our website is hosted on Shopify, which provides the ecommerce platform through which we offer our products.
We may also use third-party payment providers, delivery companies, analytics providers and other service providers in connection with the operation of the website and fulfilment of orders.
Certain links on our website may direct you to third-party websites that are not operated or controlled by AÏTHE.
Independent third-party websites are subject to their own terms and privacy practices.
SECTION 19 - USER COMMENTS, FEEDBACK AND SUBMISSIONS
If you voluntarily submit reviews, feedback, suggestions, photographs or other material to us, you confirm that you have the right to provide that material and that it does not infringe the rights of any third party or violate applicable law.
We reserve the right to remove unlawful, misleading, abusive or otherwise inappropriate user content from platforms that we control where permitted.
Nothing in this section transfers ownership of your personal data, which remains subject to our Privacy Policy and applicable data protection legislation.

These Terms and contracts concluded through the AÏTHE online store are governed by Romanian law.
Where the customer is a consumer residing in another jurisdiction, this choice of law does not deprive that consumer of mandatory protections that may apply under the law of their habitual residence.

Consumers may also have access to competent consumer protection authorities and alternative dispute resolution mechanisms provided by applicable law.
Nothing in these Terms restricts a customer’s right to address a competent court or authority.

We may update or amend these Terms from time to time to reflect changes to our website, business practices, services or applicable legal requirements.

For purchases already completed, the applicable contractual terms remain subject to the version and mandatory legal rules applicable to the relevant order.
